Statute of Limitations for Car Accidents in Houston, TX

| Read Time: 3 minutes

After a car accident, you may be left with injuries, property damage, and financial hardships. To relieve some of the financial burdens, you might consider filing a lawsuit. Before doing so, it is essential to understand the law, including statutes of limitations.  What Is a Statute of Limitations? A statute of limitations is a law that governs how long a plaintiff has to file a lawsuit. There are statutes of limitations for every kind of legal claim. Once this time clock runs out, you will be unable to recover for your losses. While you may file your lawsuit, the opposing party will likely call attention to the expiration of the statute of limitations, and your case will be dismissed. Filing your lawsuit before the statute of limitations has run is crucial. Why Do Statutes of Limitations Exist? Statutes of limitations exist for civil and criminal claims. While a statute of limitations may seem unfair or restrictive, these time limits serve a purpose. Statutes of limitations primarily serve to protect defendants from stale or frivolous lawsuits. They also encourage plaintiffs to file their lawsuits in a timely manner. The more time passes, the weaker a case can get. Evidence may be lost, people’s memories fade, and cases become harder to pursue. A statute of limitations eliminates these issues. How Long Do You Have to Make a Claim After a Car Accident in Texas? After a car accident, you must call your insurance company. While there are no laws governing how long you have to file a claim with your insurance, most insurance carriers require you to notify them as soon as possible. If you wish to pursue legal action after your car accident, the car accident statute of limitations in Texas is two years. These two years pertain to both personal injury claims and property damage claims. After the statute of limitations for motor vehicles has expired, you will no longer be able to recover for your accident. Are There Any Exceptions to the Statute of Limitations? Certain situations may allow the two-year time limit to be paused or “tolled.” Age If a person is under the age of 18, the statute of limitations does not begin to run until they reach the age of majority.  Mental Capacity If a person is of unsound mind, the statute of limitations will be tolled until they regain a sound mind.  Discovery Rule The discovery rule applies when, after an accident, a person is unaware of their injuries. Not all injuries are apparent immediately after an accident, with some injuries taking some time to surface. The statute of limitations will begin to run only once the plaintiff has discovered their injuries.  How Long Does an Insurance Company Have to Settle a Claim in Texas? Once you file a claim with your insurance company, they must either accept or reject your claim. Under Section 542.055 of the Texas Statutes, the insurance company has 15 days to do the following: Acknowledge your claim; Begin their investigation into the claim; and Request any relevant information needed to assist with their investigation. Aside from these steps, an insurer must communicate their acceptance or rejection of your claim. If the company rejects your claim, they must provide their reasons. Insurance companies may extend their investigation for up to 45 days if they have sufficient reason to do so.  Whether there is a delay in your claim process or you’ve experienced rejection, a knowledgeable attorney can help you every step of the way.  Should You Settle with Your Insurance Company? While your insurance company may present a settlement offer after reviewing your claim, we recommend that you not accept without first consulting with a personal injury attorney. Insurance companies are known to offer low or unfair settlement in an effort to resolve issues quickly and avoid legal action. Before rushing to settle, speak with a qualified and experienced attorney. Tips on Hiring the Best Personal Injury Attorney

| Read Time: 3 minutes

If you have sustained injuries in a personal injury accident, you may be in the process of looking for an attorney. For your personal injury case, you don’t just want any attorney. Rather, you want the best personal injury attorney who will help you fight for your rights and potential recovery. But where do you start?  Selecting the right attorney for you and your needs can seem difficult and overwhelming. However, knowing what to look for can greatly improve your chances of selecting the best personal injury attorney for your case.  Is It Worth Hiring a Personal Injury Attorney? Before getting too far into what to look for when hiring an attorney, let’s take one step back and address the question you might already be asking: Is it worth it to hire a personal injury lawyer?  There is often a misconception that lawyers cost more than they are worth. However, this is not necessarily the case.In fact, hiring an attorney for your personal injury case frequently results in a better outcome than you would have received without an attorney.  While each case is different and results are never guaranteed, an experienced personal injury attorney can often be an asset to your case. Things to Look for When Hiring a Personal Injury Attorney It can be difficult knowing where to even begin your search for a personal injury attorney. For example, a simple google search for “best injury attorney Houston” yields countless results. Fortunately, there are a few things you can look for to narrow down your results.  Look for an Attorney with Extensive Experience In Personal Injury Law Personal injury law can be very complicated. Accordingly, you should look for someone with extensive experience handling personal injury cases in particular. A law firm may tell you they can take your case so that they can get your business. However, you should verify that they actually have a personal injury practice. Don’t be afraid to search potential law firm websites to ensure that they have a practice area dedicated to personal injury law.Further, many attorneys will post examples on their websites of past cases and results for previous clients. Looking into these case results can be a great way to ensure that a particular firm has successfully taken on cases like yours in the past. Online Ratings and Reviews from Previous Clients Speak Volumes A great way to find a top-rated personal injury attorney is through the use of online ratings and reviews. In fact, an attorney’s previous clients are often the best resource when it comes to finding a great attorney.  Previous clients will frequently leave great reviews for attorneys who are able to get them great results. On the other hand, clients are also likely to be vocal about any less-than-stellar services received if they are unhappy. Either way, a review can tell you a lot about the attorney you might be considering. Websites like Avvo and Martindale are great resources to find reviews and ratings on the best personal injury attorneys in your area.  Select an Attorney You Can Get Along with A personal injury case can last months and even years. Thus, it is important to select an attorney whom you get along with. The initial consultation can be a great way for you to vet your potential attorney and determine if this is someone you can see yourself working with for extended periods of time.  Contact the BFH Law Group Today Finding the right firm for you and your personal injury case can be difficult. How Are Wrongful Death Settlements Paid Out

| Read Time: 2 minutes

If you have lost a family member due to the negligence of another party, you may be entitled to compensation through a wrongful death claim.  A wrongful death claim is a special type of legal claim that allows you to recover damages related to the death of a loved one. There are a number of situations in which a wrongful death claim might arise. For example, you may be able to recover on a wrongful death claim due to the negligent actions of a:  Driver,  Doctor,  Business,  Caregiver, or Manufacturer.  So long as the death of your loved one was a result of the negligent party’s actions, you may have a valid legal claim.  This can be extremely helpful in allowing you to recover from the death of your loved one. But how are wrongful death settlements paid out?  This article will discuss this important question that many wrongful death claimants have. For more information on this question and wrongful death claims in general, contact the BFH Law Group today.  Who Pays the Wrongful Death Settlement Payment? Wrongful death claims will vary from case to case. However, insurance providers are typically the party that is responsible for paying out a wrongful death settlement.  It is important to note that although insurance providers will pay out claims on behalf of their insureds, their policies will often have a policy limit. Thus, depending on the extent and severity of the damages involved in your case, you may require more compensation than the insurance policy provides.  Further, many insurers will attempt to pay out as little as possible to satisfy a claim. Accordingly, it is important to speak with an experienced attorney to discuss whether a settlement payment is fair and equitable under the circumstances.   Are Wrongful Death Settlements Taxable? According to the IRS, settlements for wrongful death claims are generally non-taxable.  A wrongful death settlement is typically comprised of “compensatory damages.” The purpose of compensatory damages is to make a person whole or replace what was lost. Examples of compensatory damages in a wrongful death case include:  Loss of the deceased’s expected earnings;  Loss of inheritance; Loss of pension plans or medical coverage;  Mental anguish or pain and suffering; and  Loss of care, protection, guidance, love, and companionship.  Thus, it is important to look at the purpose of the damages. If the damages are meant to compensate the wrongful death claimant, it is likely that the damages are non-taxable. However, if the purpose of the damages is to punish the opposing party (punitive damages), the settlement may be taxable.  How Long Does It Take to Settle Wrongful Death Claims? Unfortunately, there is no easy answer to this question. Again, because each case is different, the length of time it will take to settle will depend on the specific circumstances of your case.  Some cases take only weeks or months to resolve. However, if your case involves complicated facts or a high amount of claimed damages, it may take much longer to reach a resolution.  Contact Our Team Today If you have questions about your potential wrongful death settlement, consider contacting an attorney today. An experienced wrongful death attorney can help you assess your damages, negotiate a potential settlement, and determine how your claim will be paid out.  At the BFH Law Group, we want to help. Secrets About State Farm Car Accident Claims

| Read Time: 3 minutes

One of the leading injuries, if not the leading injury of car accident victims, is whiplash. In fact, whiplash injuries affect more than one million people in the United States every year. To make matters worse, whiplash victims must also frequently deal with insurance companies like State Farm after their accident. If you have sustained whiplash injuries in a car accident, you might have questions such as: How long does it take State Farm to settle a claim?  What is my potential State Farm settlement for whiplash?  Will State Farm help me maximize my settlement? The purpose of insurance is to help provide compensation in the event of an accident. However, there are a number of things insurers don’t want you do know. So let’s dive in and discuss the three secrets about State Farm car accident settlements that you’ll want to know to help you maximize your State Farm settlement for whiplash. Secrets of State Farm Car Accident Settlements State Farm claims that its goal is to help injured victims recover. However, State Farm’s ultimate goal is to collect the maximum amount of premiums while paying the minimum number of claims. Thus, it is important to know how State Farm operates so that you can effectively get the compensation you are entitled to recover.  Secret 1: State Farm May Attempt to Use Your Past Against You State Farm will dig into an individual’s past to find information that could justify reducing or denying a claim. For example, consider a car accident victim who is involved in a rear-end collision and sustains serious whiplash. If the victim sustained a similar injury in the past that may have contributed to their symptoms, the State Farm settlement for the whiplash injury might be reduced. State Farm will often use this tactic to reduce an injury victim’s potential recovery. Therefore, it is important to be careful with what medical records you provide to State Farm. Every request for medical records made by State Farm should be reviewed by an attorney. In fact, it is prudent to engage an attorney to assist with the entire process. Secret 2: You Do Not Have to Accept State Farm’s Offer to Settle The issues following a car accident can range from physical to emotional to economic. Financial pressures are bound to present a hardship for most injury victims. Unfortunately, State Farm is aware of these financial burdens on victims and will often use them to its advantage. However, know that you do not have to accept any offer made by State Farm, let alone their very first offer. While any amount up front may seem appealing, you very well may be entitled to even more. An attorney can help you review your offer and determine whether it is a fair representation of the compensation you will need to recover.  Secret 3: Don’t Feel Pressured to Provide State Farm with a Statement State Farm adjusters will try to pressure you to make a recorded statement. However, despite their insistence, you do not have to provide one.  Regardless of whether you are navigating a State Farm rear-end collision settlement, whiplash settlement, or any other car accident settlement, don’t feel pressured by State Farm. If the adjuster has questions about the accident or injuries sustained, there are other avenues available to them.  If you don’t feel comfortable communicating with State Farm on your own, contact an attorney to help you communicate and negotiate your claims on your behalf. Not only will this relieve some pressure from your shoulders, but it may also allow you to maximize your ultimate recovery.  Contact Our Team Today Experienced attorneys are able to recognize when State Farm uses these “tricks” to offer a lower settlement. The attorneys at BFH Law Group have six decades of combined experience helping clients in the most difficult times of their lives. Further, we know State Farm’s secrets and will fight to help you get the compensation you need to recover.
